Juvenile Delinquency Actions

Froelich Law Offices has experience in representing juveniles who have been accused of committing a delinquent act. A criminal action involving a juvenile is commenced by the filing of a juvenile delinquency petition.

The initial appearance is the first hearing where the juvenile is informed by the court of the charges set forth in the delinquency petition. An admission or denial is entered at that time. A pre-trial conference is usually set up where the prosecutor, family and juvenile along with their attorney are present. At the pre-trial conference, there is discussion about the allegations and a social worker may provide information about treatment needs. The meeting informs all parties of the status of any plea discussions.

While the case is pending, the juvenile’s attorney will access discovery materials, including juvenile reports, police reports, child protection referrals and other pertinent information about the case. All juvenile proceedings are confidential and are closed to the public. The matter is set for an adjudication hearing wherein the juvenile may enter a plea to the charge(s) or may have a contested hearing before the court. At a contested hearing, witnesses are called to testify. The court will make a determination if there is a basis for the charges set forth in the delinquency petition after the hearing. If the court finds a basis for the charge(s), then the juvenile will be found delinquent. The court will then schedule a disposition hearing. The court will order a report to be prepared by the human services department which will contain relevant and important information about the juvenile, including prior record, family background information, and recommendations. The court has the authority to place a juvenile in secure detention and may impose certain conditions on release.
